We are Property fitness (“PF) Trading name for Chameleon Ventures LTD company number 7068776. These are our terms and conditions. They tell you what we do and how we do it.

By using our site, you indicate that you accept these terms and conditions, and the referenced policies, and that you agree to abide by them.

Privacy and data protection and exchange of information

Homeowner Information as set out in PF Privacy Policy, which is incorporated herein by reference. PF holds Homeowners and tradesmen Information on a database and as part of the business System strictly in accordance with its Privacy Policy.

PF will use its reasonable endeavours to publish details of Homeowner's Project requests to Trade Businesses. Should the Trade Business express an interest in quoting for the Project then personal contact details will be sent to both the Homeowner and the Trade Business concerned.

PF will make registered user profile information including ratings and comments from users of the Website in relation to historic Projects available for users of the Website to see at any stage on the Website.

If for any reason the Homeowner does not wish any or all of the Homeowner Information to be used in the way set out in the Terms and Conditions then the Homeowner should cease to use the Services PF.

Tradesmen may only use contact information obtained from the Website or any information obtained through a communication company relating to specific Project inquiries which have been notified to the Homeowner via the Service or the Website.

Homeowners agree not to use any personal contact information of any other Homeowner or Trade Business provided via the Service or this Website for any unsolicited or commercial messages. In addition, a Homeowner agrees to only use such information in accordance with applicable laws and regulations, including without limitation data protection and privacy laws.

In addition, under no circumstances, except as defined in this Section, can a Homeowner disclose personally identifiable information about another Homeowner or Trade Business to any Third Party obtained as a result of the Services without the consent of PF and the consent of such other Homeowner or Trade Business after adequate disclosure.

PF cannot accept any liability in respect of any contract or other agreement entered into between the Homeowner and Tradesmen. In particular, but without limitation, PF can accept no liability relating to the quality of any Project performed or omitted

Services are offered on PF through either monthly options which are fixed price services; or Custom Jobs, which are, price per item. Services delivered in these ways on PF are referred to in these terms as “Jobs”, leads and monthly terms.

On the posting of a Job the Home owner uploads their requirements on the job post page.

This is and will remain to be a free service unless otherwise noticed.

Home owners can receive up to four local tradesmen request to quote for the job

Each tradesman pays a fee so we ask that home owners give them the opportunity to quote

for the job, arrange a time between yourselves for this process to occur. Upon that you can judge

which tradesman to employ. If the trades men who have bought the lead to quote/estimate for the job are not carried through due to none contact or access on the home owners part ,PF will be obliged to refund the lead cost. Multiple refunds attributed to a home owner will lead to temporary and/ or permanent restrictions on their account depending upon the severity.

PF will process approved refund requests back to the tradesman account subject to a review of the refund reason and circumstances to ensure that both parties have complied with these terms and conditions, and that the purpose of the refund is not to avoid any of the parties’ obligations under these terms and conditions. If PF reasonably believes that the parties have not complied with these terms and conditions or are seeking to avoid any such obligations PF shall not be obliged to make the refund. Actions like this will result in warnings and possible suspension of account.

Property fitness (PF) - Terms & Conditions
User accounts

To use PF, Users have to register for an account, provide accurate and complete information, and keep their account information updated. Both Home owners and Tradesmen undergo the same account registration process.

Each account must be a personal account, but Users may trade as a sole trader, company or any other legal entity (whether incorporated or unincorporated).

Users cannot register for more than one account.

The information that Users supply in the public profile of their account must comply with PF profile policies.

PF reserve the right to restrict your access, temporarily or indefinitely block your account, stop any Jobs you have in progress, warn other Home owners and Tradesmen of your actions or issue you a warning if:

  1. you breach the letter or spirit of these terms and conditions or the referenced policies;
  2. we are unable to verify or authenticate any information you provide to us;
  3. we believe that your actions may cause any loss or liability to our Users or to us

Home owners and tradesmen are solely responsible for any activity that occurs on their account, unless it is a result of actions beyond their control (such as hacking or if someone steals their password when they have taken reasonable steps to keep it secure). Users may never use another person’s user account or registration information for the Website.

All tradesmen on PF must strive to deliver a high standard of work, appropriately meeting their home owner’s needs. The Home owner and Tradesman create a direct service contract between themselves and PF are not party to that contract.

Feedback

When the Job is completed and the tradesman has been paid by the home owner, the home owner is asked to provide feedback and a rating from 1-5 for the other party. This rating influences each tradesman ranking on PF.

The home owner should complete the feedback honestly. Users must not falsify feedback, manipulate or coerce another User by threatening negative feedback or offer incentives in exchange for feedback. Any attempts of this nature should be reported immediately to PF.

Feedback comments that are reported to us as defamatory, abusive or offensive will be reviewed and dealt with accordingly. PF encourage our home owners and tradesmen to try and resolve any disagreements between themselves. However should that not be possible PF Customer Services can provide Dispute resolution.

A Dispute can be raised as follows:

  1. by the Home owner manually while or after a tradesman is on or finished a job
  2. by a tradesman automatically when the job is finished.

If a resolution cannot be mutually agreed between both parties within seven (7) days, including if either party are un contactable during this period, PF will make a resolution decision on behalf of both parties.

In the event of having to make a resolution decision, PF will use only the communication in emails as sole evidence, and consider: if both parties are acting in good faith and have tried to resolve the issue between themselves before contacting us, including at least a second attempt made between both parties to complete or rectify the Job;

Charges for job leads vary and will be charged accordingly

PF charge an admin fee for all invoices of £0.50

All charges are subject to vat at the current UK rate

By proceeding to use the PF service Users consent that PF may process the personal data (including sensitive personal data) that PF collects from them in accordance with the PF Privacy Policy.

Governing Law

These terms and conditions and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales. The courts of England and Wales shall have non-exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with these terms and conditions or their subject matter or formation (including non-contractual disputes or claims).

User Content’ means all Content uploaded, submitted, distributed, or posted to the services by Users, including without limitation, Proposals and communication via the Work Stream. User Content

The Company's rights

PF reserves the right to modify or discontinue all or part of the Website or the Service temporarily or permanently with or without notice to a Trade Business or private individual for any modification to or discontinuance of the Website or the Service.

PF may change the Terms and Conditions from time to time and shall post such alterations on the Website and shall update the Terms and Conditions were last modified at the beginning of the relevant document. If a Trade Business, on behalf of itself and its Sub-Contractors, does not agree to the changes made to the Terms and Conditions the Trade Business must stop using the Website and the Service. The continued use of the Website and the Service by the Trade Business after the date the changes have been posted will constitute acceptance of the amended Terms and Conditions by the Trade Business on behalf of itself and its Sub-Contractors.

As part of its Service to Homeowners PF strongly advises Homeowners to request evidence of applicable trade accreditations , CRB checks and solvency checks from a Trade Business and its Sub-Contractor(s) prior to the Trade Business or Sub-Contractor commencing work on a Project. The Trade Business must comply and must procure that its Sub-Contractor complies with any reasonable requests submitted by the Homeowners with regards to the verification of such information.

Any checks on trade accreditations or registrations carried out by the Company do not reduce the obligation of the Trade Business to ensure that all its Sub-Contractors and any personnel involved in the Project have the required trade accreditation or registration to carry out specific aspects of the Project where required to do so.

PF accepts no liability for any failure by the Homeowner to carry out appropriate checks in relation to a Trade Business or Sub-Contractor.

Intellectual property rights

PF hereby acknowledge that all present and future copyright and other intellectual property rights ,in used in connection with, the Website , including the manner in which the Website looks or appears and all information relating thereto is the property of the PF and nothing contained herein shall be construed so as to transfer any such rights to any Business.

PF owns the rights to all trademarks and logos associated to them throughout the world

PF makes no warranty that the Website or use of the Services will meet your requirements or will be, error-free.

No warranty is given by PF that all information obtained from here is accuracy or any information obtained through the Website or the Services or any defects in the Website or the Services will be corrected and the Homeowner understands and agrees that any material or data obtained through use of the Website or the Services is at their own discretion and risk.

PF accepts no liability for any failure by the Homeowner to carry out appropriate checks in relation to a Trade Business or Sub-Contractor.

Agreement

This Agreement shall be subject to the laws of England and Wales and the parties shall submit to the exclusive jurisdiction of the English courts.

Definitions

User. Any person using the site

PF. means the website with the domain name www.propertyfitness.co.uk or Property Fitness as the context so requires;

Payments. Charges paid by users of the site

Feedback. Information left by users of the site

Refunds. Payment return

Dispute. means a dispute raised in relation between a home owner and tradesman, a rejected Invoice or a rejected Refund Request

Post job. Where jobs are created

Post renovation. Where renovation jobs are created

Job list. Where jobs are posted by home owners

Renovation list. Where renovation jobs are posted

Homeowner(s)". means - person, persons, companies or other

'Commencement of the Job. means the approval of the chain reaction

‘Content. Means such things as data, text, photographs, videos, audio clips, written posts and comments, graphics, User content and interactive features generated, provided, or otherwise made accessible on or through PF

'Invoice. Means a bill issued to paying users of the site

'Job. means a piece of work that a home owner and tradesman agree via PF is to be provided by the home owner to the tradesman.

Lead. means a job advertise by a home owner which has a charge to access it
